General Terms and Conditions

The rental agreement is valid between the rental company A.R.C. Away Rent a Car and the renter of the vehicle. The car rental period starts from the time of rental until the vehicle has been returned to the agreed destination and there are no claims from either party. In the case of any claims the rental agreement is extended until all issues have been solved. All claims must be reported in writing within 30 days after returning the vehicle.

The duration of one car rental day is 24 hours. A rental interval of more than 1 hour beyond a full  day  will be charged as an additional rental day.

Fuel cost is not included in the rent. The vehicle is given to the renter with a full tank and the renter is required to return the vehicle with a full tank. If the renter does not return the vehicle with a full tank, the renter will be required to pay for the cost and service of refueling the vehicle. It is the renter’s responsibility to use the appropriate and good quality fuel for refueling the vehicle. The renter is liable for all damages caused by using inappropriate fuel.

Renter’s rights and responsibilities

The renter has the right to use the vehicle.

The Renter is allowed to use the vehicle and cross the borders to the following countries: Austria, Belgium, Denmark, Estonia, Finland, France, Germany, Great Britain, Ireland, Italy, Latvia, Lithuania, Luxembourg, Monaco, Netherlands, Norway, Poland, Portugal, Spain, Sweden.

The renter must pay for the full rental period at the time of the rental.

The renter must inspect the vehicle before he or she starts using it and make sure that the vehicle is suitable and in good condition. The renter’s signature confirms that the renter has found no faults.

The renter is required to use the vehicle in normal activity and treat it respectfully. The renter cannot use the vehicle for illegal activity, for towing, racing, or for driving lessons etc.

The renter is not allowed to give the vehicle to the third party user. If the renter gives the vehicle to the third party all possible damages and losses will be the responsibility of the renter. The renter can give the vehicle to the third party only with the written permission from the rental company. Even then the responsible party will be the renter.

The renter must avoid as much as possible any possible damages to the rental company and third parties.

The renter undertakes special diligence to follow the traffic rules and road safety and does everything possible to prevent damage.

When parking the vehicle, the renter shall comply with all parking rules and with general traffic safety, not leave objects and things in the car that attract third parties for criminal activity. The renter must lock the doors and turn on the alarm system. The renter is required to make every effort not to put the keys in the possession of third parties.

In the case of a traffic accident, theft, vandalism etc the renter is required to inform the rental company immediately about the incident. If the incident requires legal assistance by the police, ambulance or the like the renter is required to contact them directly.

The renter shall be liable for all damages to the vehicle or equipment during the rental period that are not covered by the insurance company.

The renter is liable for all lost or exchanged equipment and parts accompanied with the vehicle.

The renter is required to pay all fines and penalties that occur during the rental period such as for ignoring parking and traffic rules. In the case of not paying the fines the rental company has the right to charge double the amount of fines.

If the insurance company refuses to cover the loss or the damage is not covered by the insurance the renter must reimburse the full value of the vehicle or compensate the losses incurred to the rental company.

All damages to the vehicle that are caused by the renter or third parties are fully compensated by the renter.

All damages to the rental company or to the third party that are caused by the renter or additional driver due to neglect or inappropriate action are fully compensated by the renter.

The renter is fully liable for all losses and damages that are caused under the influence of any narcotic, alcoholic or other toxic substances either by the renter or the additional driver.

If the returned vehicle needs to be repaired, the renter is required to pay the full rental day price for each day of repair in addition to all expenses that are not covered by the insurance company.

If the vehicle is returned with missing vehicle documents, keys or equipment the renter is required to pay fixed fee to the rental company.

Rental company rights and responsibilities

The rental company is required to guarantee the availability of the vehicle to the renter at a time and place specified in the rental agreement.

The rental company is required to perform regular vehicle inspections and technical services.

The rental company enters the agreement in good faith.

The rental company has the right to require monetary security deposit up to three times the total rental price.

The rental company determines the place of repair, conditions and scope irrespective to the location of the damaged vehicle.

The rental company has the right to refuse of renting the vehicle or terminate the rental agreement if the renter or additional driver create suspicion or the rental company has reasons to believe that the vehicle will be used for malignant activity or the vehicle will be misused.

Losses due to vehicle breakdown and other incidents during the rental period such as traffic accident, trip cancellation or interruption, illness etc. are not covered by the rental company. These expenses are covered by the renter and go with the rental risk.

For each loss or damage causing incident the rental company has the right to charge triple amount of the total rental price as the means of fine in addition to all expenses related to the loss if the renter does not inform the rental company of the incident before or at the time of the return of the vehicle.

Use of the vehicle

The vehicle can be used by drivers between the age of 21-99 while the driver between the age of 21-24 is categorized as a young driver. Additional CHF 10 per day or maximum  total of CHF 100 applies as a young driver fee.

The driver of the vehicle must have a minimum of 1 year of valid international drivers license without major violations. If the renter’s drivers license is not in Latin alphabet, for example Arabic, Greek, Russian or Chinese, it is required to present the international driver’s license (IDL). 

Additional driver fee is CHF 8 per day. Adding an additional driver does not require changing the reservation details. The information regarding the additional driver can be added to the existing rental agreement at the time of the rental.

Additional equipment (available upon prior request)

Baby seats: 15-30 kg CHF 7 per day, maximum CHF 40 per rental period

Baby seats: 9-18 kg CHF 7 per day, maximum CHF 40 per rental period

Baby seats: 0-13 kg CHF 7 per day, maximum CHF 40 per rental period

GPS: CHF 15 per day, maximum CHF 150 per rental period

Ski box: CHF 4 per day, maximum CHF 40 per rental period

Snow chains: CHF 4 per day, maximum CHF 40 per rental period

Mileage

Mileage is unlimited.

Taxes

All taxes are included  in the rental price

Payment methods

The following credit cards are accepted as the means of payment: Mastercard, Visa and American Express. The credit card must belong to the renter, which they have to present at the time of rental. This is necessary to verify the owner of the card and to guarantee the security deposit until the return of the vehicle. The security deposit (see 3.4 above, up to three times the rental price) is required amount which is kept as an additional insurance payment and fuel charge, however it varies on the type of the vehicle, driver’s age, duration of the rental period and the location of the vehicle pick up. If the renter does not present the valid credit card or there is not enough money on the card the rental company has the right to refuse of renting the vehicle. In such case any of the prepaid amounts will not be returned.

Applicable Law

Swiss Law exclusively
